Mr. Ruby heads the firm’s bankruptcy and creditors’ rights practice. In addition, Mr. Ruby represents clients in business, transactional, commercial, tax and non-profit matters. Clients include local, regional, national and international concerns.

Mr. Ruby regularly receives conflict and local counsel referrals from large nationally-recognized law firms and corporate in-house counsel.

He has taught as an adjunct professor in the T.C. Williams School of Law and was named by Virginia Business Magazine a member of Virginia's "Legal Elite" for 2007 in Bankruptcy.  David Ruby has also been recognized by Virginia Super Lawyers as a Super Lawyer for 2008.
EXPERIENCE
  • Representation of lenders, borrowers, sellers, purchasers, landlords, tenants and others in a broad range of financing, transactional, acquisition, real estate and financial matters.
  • Representation of creditors and other non-debtor parties in business and consumer Chapter 7, 11 and 13 bankruptcy cases.
  • Representation of business debtors in Chapter 7 and 11 bankruptcy cases.
  • Bankruptcy litigation, including asset sale, financing, relief from stay, cash collateral, adequate protection, turnover, abandonment, landlord-tenant, executory contract, disclosure statement, plan, tax, lien priority, claim, reclamation, discharge, exemption and preference and fraudulent transfer matters, actions, contests and controversies.
  • State court litigation, including asset recovery and collection matters.
  • Out-of-court/out-of-bankruptcy business and loan reorganizations, workouts and restructurings.
  • Acquisition and financing of troubled businesses inside and outside bankruptcy.
  • Foreclosures, repossessions and liquidations.
  • Representation of taxpayers before Internal Revenue Service and Virginia Department of Taxation.
  • Formation of tax-exempt organizations and attaining recognition from Internal Revenue Service.

    • Business, commercial and real estate entities and interests
    • Institutional lenders
    • Investor, purchaser and creditor groups and committees
    • Governmental entities
    • Bankruptcy trustees
    • Religious institutions and non-profit organizations
    • Individuals

Current Appointments include:

    • Special bankruptcy counsel to the Attorney General of the Commonwealth of Virginia. In such capacity, Mr. Ruby has represented various departments, agencies, commissions and other state interests in large bankruptcy cases.
    • Chapter 7 trustee in the Newport News Division of the United States Bankruptcy Court for the Eastern District of Virginia
